| Seller warrants its products to be free from defects in design, material, and workmanship under normal use and service. Seller will repair or replace without charge any such product it finds to be so defective on its return to Seller within 12 months after date of shipment by Seller. The foregoing is in lieu of all other expressed or implied warranties (except of title), including those of merchantability and fitness for a particular purpose. The foregoing is also Purchaser's sole remedy and is in lieu of all other guarantees, obligations, or liabilities or any consequential, incidental, or punitive damages attributable to negligence or strict liability, all by way of example; nor, except as it may otherwise specifically agree in writing through an authorized representative, shall the Seller be liable for transportation, labor, or other charges for adjustments, repairs, replacement of parts, installation or other work which may be done upon or in connection with such products by the Purchaser or others. While we provide application assistance on AIRTROL products personally and through our literature, it is up to the customer to determine the suitability of the product in the application. |

Warning
Regarding Life Support Applications
|
| Airtrol Components' products are not sold for applications in any medical equipment intended for use as a component of any life support system unless a specific written agreement pertaining to such intended use is executed between the manufacturer and Airtrol. Such agreement will require the equipment manufacturer either to contract for additional reliability testing of the Airtrol parts and/or a commitment to undertake such testing as part of its manufacturing process. In addition, such manufacturer must agree to indemnify and hold Airtrol harmless from any claims arising out of the use of the Airtrol parts in life support equipment. |
